Notice of expiry of CreditExpert subscription

Dear CreditExpert Member,

You are receiving this notice because your CreditExpert annual subscription will expire within the next few weeks. You were directed to this notice via our e-mail and/or sms alert, advising you of the date on which your annual CreditExpert subscription will expire. You are entitled, by law, to be advised of your options upon expiry of your subscription.
Renewal
If you choose to renew your subscription to CreditExpert, your renewed subscription will be subject to the terms and conditions explained below, and at the fees that you can find on the CreditExpert.co.za website. You can view CreditExpert product pricing, and renew your annual or monthly contract, by visiting About our products.

If you renew your annual subscription you will have the benefit of lower fees for a once-off payment. However, you will not be bound to use the subscription for the entire year, and you can cancel it at any time. We will refund the un-used portion, of the subscription on request, provided that the refund portion is not less than R4.00 – without penalties. Just give us 20 business days’ notice that you want to cancel, by e-mailing us on consumer@creditexpert.co.za, sending a fax to (011) 707 6700 or by calling our Help Desk on 0861 10 56 65. Cancellation on Expiry (For once-off products, when a product reaches its expiry date, no notice or request is required from member)
If you wish to cancel your annual or monthly subscription when it expires, you can let us know by e-mailing us on consumer@creditexpert.co.za, sending a fax to (011) 707 6700 or by calling our Help Desk on 0861 10 56 65. Alternatively, you can go online and cancel it at your own convenience.

Please Note:that a cancellation for a recurrence needs to be done at least 5 business days before the next Debit Order goes off. Late cancellation will result in the Debit Order going off and only having the next set of Debit orders cancelled.

Cancelling a recurring subscription cancels the Debit order and not the product. The product will be cancelled once the product expires and member will have neither the payment recurrence nor the product linked to him. As for once-off products, the product is automatically cancelled at the end of its expiry date.

However, you will not be bound to use the full subscription and you can cancel it at any time. We will refund the un-used portion of the subscription on request, provided that the refund portion is not less than R4.00 – without penalties.
Automatic Yearly Subscription
If you do not renew or cancel your current annual subscription, you will automatically be subscribed to CreditExpert for another year. The fees are available on the About our products page on the CreditExpert.co.za website. The yearly fee is payable in advance.

You can pay using your credit card, debit order or via cash deposit. Once we receive your yearly payment, you will be able to enjoy unlimited online access to your Experian credit report for a year. The yearly subscription will renew each time we receive payment.
Automatic Monthly Subscription
If you do not cancel your current monthly subscription, you will automatically be subscribed to CreditExpert on a month by month basis. The fees are available on the About our products page on the CreditExpert.co.za website. The monthly fee is payable in advance.

You can pay using your credit card, debit order or via cash deposit. Once we receive your monthly payment, you will be able to enjoy unlimited online access to your Experian credit report for a month. The monthly subscription will renew each time we receive payment.

Experian Credit Expert Terms and Conditions of Agreement

Thank you for choosing Experian Credit Expert to manage your credit information. These are the terms of our agreement. If you indicate that you agree to the terms and conditions, you agree, and are legally bound, to use CreditExpert only in the manner that we have agreed to between us.

IMPORTANT NOTICE TO CONSUMERS
We want to draw your attention to some of the most important terms that you will agree to if you agree to the terms of subscribing to our CreditExpert service, because these terms mean that you agree that:

• Experian's risk or liability is limited,
• you assume certain risks,
• you indemnify Experian, or other persons, against damage in certain instances, and
• you acknowledge the existence of certain facts.

These terms are easy to find because they are typed in bold and coloured blue in the Terms and Conditions. If you do not agree to, or if you do not understand the meaning, including the nature and effect of signing these terms, please do not continue.

1. OUR DETAILS
1.1. This agreement is between yourself and Experian South Africa (Pty) Limited, registration number 2006/010440/07. Our physical head office address is Experian House, Ballyoaks Office Park, 35 Ballyclare Drive, Bryanston Extension 7. You can reach us at info@experian.co.za, or on 0861 10 5665.
1.2. Experian is a Credit Bureau, registered in terms of the National Credit Act 34 of 2005.

2. WHAT ARE THE SERVICES OR PRODUCT WE PROVIDE TO YOU
2.1. We will provide you with the services or products we describe on our website, at the prices indicated on the website.
2.2. You have a few options in terms of products and types of subscriptions, ranging from obtaining your once-off free credit report, to a year-long subscription for which you pay once or on a recurring basis in advance.
2.3. We will provide the products and services with reasonable care and skill and will reasonably ensure that the services or products are substantially as described on the website and in these Terms and Conditions.

3. LONG TERM SUBSCRIPTIONS (FOR MORE THAN ONE MONTH)
3.1. If you have subscribed for a continuous period of longer than one month, we will from time to time send you a newsletter to let you know what the new prices and product or service offerings we have for the next year are.
3.2. We must, by law, send this notice to you even if you indicated to us that you no longer want to receive marketing material from us.
3.2. You can pay using your card, bank account or via cash deposit. Once we receive your payment, only then will you be able to enjoy unlimited online access to your Experian credit report. The yearly recurring subscription will renew each time we receive payment. If the yearly subscription is on a once-off option, then the subscription will not be renewed upon the expiry date.

4. MONTH-TO-MONTH SUBSCRIPTIONS
4.1. The Monthly Recurring CreditExpert is offered only as a recurring product. If you subscribe to this product, you will be debited on a monthly basis up until the product is cancelled.
4.2. You can pay using your card or bank account. Once we receive your monthly payment, only then will you be able to enjoy unlimited online access to your Experian credit report for a month. The monthly subscription will renew each time we receive payment.
4.3. If you wish to cancel your monthly subscription, you can let us know by e-mailing us on consumer@creditexpert.co.za, sending a fax to (011) 707 6700 or by calling our Help Desk on 0861 10 56 65. Alternatively, you can go online and cancel it at your own convenience.
4.4. If the Debit Order subscription is cancelled, please note that although the recurrence is cancelled, you will still have access to the product up until its expiry date.

5. YOUR SECURITY
5.1. We take your privacy very seriously and we comply with the relevant provisions of South African law, including the National Credit Act, the Consumer Protection Act and once made law, the Protection of Personal Information Act. You agree that we may use the information that you provide to us for the purpose of delivering our services to you and to update and verify your information stored on the bureau, and we undertake that we will use that information only in accordance with the law.
5.2. Please be aware that we may record telephone calls you make to our call centres for training, audit, the prevention of fraud and corruption and quality purposes.
5.3. To be able to use some of the Services or products you will need to register on the Website and log-in using your unique log-in details supplied as part of the registration process (e.g. username, password).
5.4. You are responsible for keeping your log-in details confidential and they should not be shared with anyone. The information on your credit report is very sensitive and can be abused to commit fraud against you.
5.5. You should contact us as soon as possible if you believe that anyone has obtained your log-in details without your permission or if you become aware of any other breach of security on the website. We will not be responsible to you if there is unauthorised access to your log-in details or unauthorised activity on the website as a result of your log-in details becoming known by someone else, unless this is due to our negligence.

6. USE OF THE WEBSITE
6.1. You may use the website for your own personal and non-commercial purposes. You may not access the website to gain access to any content unlawfully. We do not give you permission to do anything with the website except to browse the contents and use any services or products we make available to you.
6.2. You must take care not to do anything that could harm the Website or the computer systems which host the Website. You must not do anything that restricts or inhibits the use and enjoyment of the Website by other users.
6.3. You are responsible for ensuring that any information you submitted to the Website is true and accurate and free from viruses and other harmful code.
6.4. We may terminate or suspend your access to log-in areas of the website after giving you 20 (twenty) days notice if, in our view, there has been a serious failure by you to comply with your responsibilities in these terms and conditions (for example non-payment or misuse of the website for fraud, misuse of your log - in details or causing damage or trying to cause damage to the website).
6.5. You may not manipulate any information or data that you find on the website and you may not copy anything, combine it with other information, create any databases or otherwise store any information you retrieve from the website, and you may not publish anything, disseminate or distribute anything or use anything for your personal gain.
6.6. You must adhere to our reasonable requests in connection with data security and you may not tamper or try to over-ride any security device or measure on the website.

7. INTELLECTUAL PROPERTY RIGHTS
7.1. The content of the website is our intellectual property and will remain our property when you use the website.
7.2. None of the content contained in the website may be reproduced or redistributed without our prior written permission, except that you may download or print a copy of your credit report for your own personal non-commercial use.
7.3. Product names, trademarks or services or products names or marks or company names mentioned on the Website are the trademarks, product marks, or business names of their respective owners. The word "EXPERIAN" and other words and graphical devices in respect of particular services or products are trademarks of Experian Limited and/or its associated companies and may be registered in the EU, USA and other countries.
7.4. You may not use or duplicate the intellectual property or the intellectual property of any third parties for your personal use or for any other use.

8. EXCEPTIONS TO OUR OBLIGATIONS AND LIMITATION OF OUR LIABILITY
8.1. While we try to ensure that the website is functioning correctly, this may not always be achievable. We do not guarantee that the website or products or services or products will be available all the time or at any specific time. They may be temporarily suspended if our computer systems used to provide the website are under repair or maintenance or are otherwise unavailable.
8.2. We do not guarantee that the website will be compatible with all or any hardware and software which you may use. For example, the website may not display or operate correctly if you access them using a mobile phone or similar device.
8.3. We take steps to ensure that the website and reports we give you are free from computer viruses and other harmful computer programs. However, we cannot guarantee this due to the nature of the Internet. You are advised to use appropriate firewall and anti-virus software to protect your computer and data.
8.4. We use reasonable skill and care in the sourcing and supply of the information which is made available to you on or in connection with the Website or Services or products. However, in the case of information we obtain from third party sources (including the details supplied by you), we cannot guarantee that any of that information is correct, accurate, complete, error free or up-to-date.
8.5. Nothing provided by us on or in connection with the website or services or products (including but not limited to our email alerts) is, or shall be deemed to constitute financial, legal or other advice. The information we provide is not intended to be relied on by you in making (or refraining from making) any specific decision or to replace independent professional advice. Any and all information provided by us on or in connection the Website is for general information purposes only.
8.6. Except for the commitments we expressly make in these Terms and Conditions and any additional commitments arising out of your consumer rights granted by law, we do not make any other commitments or warranties about the website or the services or products.

9. OUR LIABILITY TO YOU AND LIMITATIONS OF LIABILITY
9.1. Nothing in these Terms and Conditions excludes or limits our liability in respect of (a) death or personal injury caused by our negligence, (b) our fraud, (c) any other matter which it would be illegal for us to exclude or limit or to attempt to exclude or limit our liability, or (d) our duties or liability under the Consumer Protection Act 68 of 2008.
9.2. We are not responsible to you for any loss or damage suffered by you which was not a reasonably foreseeable or an obvious and direct consequence of us breaching these Terms and Conditions - for example, if you and we could not have anticipated those losses before or when you accessed the Website or used the Services or products or it was not obvious that those losses would result.
9.3. We are not responsible to you for losses which you suffer due to any events beyond our reasonable control.
9.4. We are not responsible to you for losses which you suffer which are not directly caused by our actions (or our failure to act).
9.5. Unless we have been negligent then we are not responsible to you for any damage caused to any hardware or software used to access, use or download the Services or products.
9.6. We are not responsible to you for losses you suffer under any contract you have with a third party through which your access to the services or products and/ or any website is arranged or paid for.
9.7. Except as otherwise stated in these Terms and Conditions, we will not be liable to pay you more than R1500 for damages you suffer in connection with your use of all the services or you access to the website, (including the Website from which the relevant Services or products is provided).
9.8. Our liability to you shall not include the following business losses that you may incur: lost business data, lost profits, lost earnings, loss of an opportunity to make profit or reduce debt, business interruption or reduction in the value of an asset. We shall not be liable to you for any business losses if the Services or products are provided for your own personal use as a consumer.
9.9. We cannot be held responsible when your use of the website or our services does not have any specific outcome for you.
9.10. The data you see on your credit report is data that we received from other parties, including banks, courts and other government information providers such as the deeds office. We take reasonable care to make sure that the data on your record is correct but we cannot guarantee that any information we receive from third parties is complete, correct, up to date or true. We cannot be held responsible if the data on your record is not correct.

10. COMPLAINTS
10.1. In the unlikely event that you have cause to complain about any of our services or products, our contact details can be found on the relevant Website.
10.2. You can also contact the National Credit Regulator or ombud, who's details you will also find on the website.

11. CHANGES TO THESE TERMS AND CONDITIONS
11.1. Sometimes, because of changes to the website or services or products, changes in the law or our arrangements with third parties, we may have to make changes to these Terms and Conditions. You can tell when changes have been made by checking the version and date on which they were last modified indicated at the start of these Terms and Conditions.
11.2. Note that every time you log into the CreditExpert Application, you are accepting the latest Terms and Conditions. It is therefore you responsibility to ensure that apart from checking the version and date of modification, you read through the amended Terms and Conditions.

12. OTHER IMPORTANT INFORMATION
12.1. These Terms and Conditions is a contract between you and us and form the entire agreement between us in connection with your use of the Experian website and your access to your credit report.
12.2. You may not transfer any of the rights granted to you under these Terms and Conditions to any other person.
12.3. We may in our discretion discontinue or modify any of the Website or Services or products at any time. We will try to ensure that any such discontinuation or modification does not materially adversely affect the nature of the services or products provided to you.
12.4. You must not create hypertext links to the Website without our prior written permission.
12.5. All communications between us will be conducted in the English language.
12.6. Any notices we send to you will be sent to the most recent e-mail address or postal address provided to us by you when you subscribe or access the website.
